These Website Terms of Use apply to use of the Lateral Cyber website, including browsing pages, submitting enquiry forms, using contact links, downloading or viewing information, and communicating with Lateral Cyber through website-related channels.

These terms are designed to explain the boundaries of the website and general information provided online. They do not replace any written proposal, service agreement, statement of work, quote, invoice terms or other written agreement that applies to paid or client-specific work.

1. About Lateral Cyber

Lateral Cyber provides practical website, email, Google Workspace, systems and cyber support for businesses. Services may include website setup and care, business email and workspace support, cyber reviews, cyber policies and procedures, governance support, support blocks and monthly care services, depending on the agreed scope.

2. Acceptance of these terms

By accessing or using this website, you agree to use it responsibly and only for lawful purposes. If you do not agree with these terms, you should not use this website.

3. Website information is general only

Information on this website is provided for general business information only. It is not legal advice, privacy law advice, insurance advice, financial advice, compliance sign off, technical certification, formal audit opinion or a complete assessment of any business, system, process, risk position or legal obligation.

4. No client relationship from website use

Viewing this website, submitting an enquiry, receiving a general reply, joining a call or receiving general information does not create a client engagement. A client engagement only begins when scope, fees, responsibilities, timing and service terms are agreed in writing.

5. Enquiries and initial contact

Website forms and contact links are provided to start a conversation. Lateral Cyber may respond to enquiries, ask for further information, recommend a next step, decline work, suggest a different support option or confirm that a formal proposal is required before work can begin.

6. Do not send passwords or sensitive evidence through website forms

Visitors must not submit passwords, MFA codes, recovery codes, credentials, confidential system evidence, sensitive client records, private keys, payment card details, security tokens, identity documents or other sensitive material through the website form or ordinary email unless Lateral Cyber has specifically agreed a secure method for that material.

7. Service scope must be agreed in writing

Any paid or client-specific work must be agreed separately in writing. The agreed scope may be set out in a proposal, quote, invoice, service agreement, statement of work, email confirmation or other written record. The agreed scope may include deliverables, access requirements, evidence requirements, timing, fees, exclusions, assumptions, responsibilities and limits.

8. Order of documents

If there is any inconsistency between these Website Terms and a later written agreement for paid work, the later written agreement will apply to the extent of the inconsistency. Website content is not a promise that every listed service, feature, output or timeframe will apply to every client or project.

9. Quotes, proposals and availability

Any prices, service descriptions, timeframes or examples shown on the website are general unless stated otherwise. Quotes and proposals may be subject to validity periods, scope assumptions, access availability, client responsiveness, third party availability and other project factors.

10. Payment terms for paid work

Payment requirements for paid work will be set out in the relevant proposal, invoice, quote or written agreement. Work may not begin until required information, access, approvals and payment have been received, where applicable.

11. Client responsibilities

Clients are responsible for providing accurate information, confirming authority to request work, maintaining appropriate backups, reviewing drafts and recommendations, making business decisions, providing timely feedback, approving changes, and implementing agreed actions unless Lateral Cyber has agreed in writing to complete those actions.

12. Authority to provide access or evidence

Any system access, evidence collection, screenshot review, export review, configuration review, website change, email change, DNS change or implementation support must be authorised before work begins. The client is responsible for confirming that it has authority to provide access, instructions, materials and evidence.

13. Access methods and security

Access methods must be agreed before use. Lateral Cyber may refuse to receive credentials through insecure channels, may request safer alternatives such as screen share or role-based access, and may decline work where access, authority, scope or evidence handling is unclear.

14. Cyber risk cannot be eliminated

Cyber risk cannot be removed completely. Lateral Cyber services may help identify risks, prioritise actions, improve visibility, document controls or support uplift based on the agreed scope and available evidence. No service guarantees that all risks will be identified, that systems are secure, that incidents will not occur, that data will never be lost, or that a specific business outcome will be achieved.

15. Cyber reviews and health checks

Cyber reviews, cyber health checks, gap reviews, sensitive data reviews and readiness checks are limited to the agreed scope, evidence and access. They are not penetration testing, forensic investigation, vulnerability exploitation, legal compliance sign off, formal certification or a complete audit unless specifically agreed in writing.

16. Frameworks and readiness reviews

References to frameworks such as the Essential Eight are provided for practical readiness and improvement planning unless a formal assessment scope is specifically agreed in writing. A readiness review is not certification, accreditation, assurance, legal compliance sign off or a guarantee of maturity.

17. Policies, procedures and governance documents

Policy and procedure work is prepared for the agreed business context and scope. Documents may require review by legal, HR, privacy, compliance, operational or industry-specific advisers before adoption. The client remains responsible for approval, rollout, staff communication, enforcement, review and ongoing maintenance unless otherwise agreed in writing.

18. Website development and website support

Website development, website setup, website updates, website care, form setup, domain support, DNS prompts, SSL prompts, Search Console support and related digital support are limited to the agreed scope. Unless separately agreed, services do not include complex software development, ecommerce management, advanced SEO, paid ads management, branding strategy, copywriting beyond the agreed scope, ongoing unlimited changes or 24/7 website support.

19. Website content, approvals and revisions

Clients are responsible for supplying accurate content, images, logos, approvals and business information needed for website work. Drafts, revisions and changes are limited to the agreed scope. Additional requests, late content changes, major redesign requests or work outside scope may require a revised quote or support block.

20. Website launch and post-launch changes

A website may be launched or handed over once the agreed launch requirements are met. After launch, new changes, extra pages, new forms, design changes, content rewrites, platform changes, troubleshooting or additional support may be treated as separate work unless included in the agreed scope.

21. Search engines, SEO and advertising outcomes

Lateral Cyber may help with practical search visibility basics such as page titles, meta descriptions, sitemap, robots file, Search Console prompts or structured website setup where agreed. Search rankings, traffic, enquiries, advertising performance, conversion rates and search engine indexing decisions are not guaranteed.

22. Business email and workspace support

Business email, Google Workspace, Microsoft 365, user access, MFA, file sharing, forwarding, third party app prompts and workspace hygiene support are limited to the agreed scope. Unless separately agreed, this work is not a full managed IT helpdesk, full tenant administration, 24/7 monitoring, email migration service or emergency support service.

23. Domains, DNS, hosting and third party platforms

Website and email work may involve third party providers such as domain registrars, DNS providers, Cloudflare, hosting platforms, website platforms, form services, analytics services, advertising platforms, Google Workspace, Microsoft 365, payment platforms, file storage tools or other providers. Lateral Cyber is not responsible for third party outages, pricing, terms, security, support delays, account suspensions, platform changes, data handling or service failures unless specifically agreed in writing.

24. Backups and business continuity

Clients remain responsible for maintaining suitable backups and business continuity arrangements unless backup setup or review is expressly included in the agreed scope. Before changes are made to websites, domains, email, files or systems, clients should ensure appropriate backups or rollback options are available.

25. Implementation support blocks

Support blocks are limited to the agreed number of hours and agreed actions. They do not include unlimited fixes, emergency incident response, major migrations, full managed IT support, complex development, work outside scope, or third party costs unless agreed in writing.

26. Monthly services

Monthly services are limited to the agreed monthly inclusions, support cap, review rhythm and minimum term. Unused time, rollover arrangements, reporting, meetings, response times, exclusions and cancellation terms should be confirmed in the applicable proposal or service agreement.

27. No emergency incident response unless agreed

Lateral Cyber does not provide emergency cyber incident response, digital forensics, ransomware negotiation, 24/7 monitoring, crisis communications, legal breach advice or urgent recovery services unless a specific written emergency response scope has been agreed.

28. Intellectual property

Website content, branding, designs, graphics, templates, reports, documents, methods, checklists, website text, code, page layouts and other materials created or supplied by Lateral Cyber remain owned by or licensed to Lateral Cyber unless otherwise agreed in writing. Client-owned materials remain the client's responsibility and must be supplied with appropriate rights for use.

29. Client materials and permissions

Clients must ensure they have permission to use any logos, images, text, fonts, documents, screenshots, third party materials or data supplied to Lateral Cyber. The client is responsible for claims arising from materials they provide or instruct Lateral Cyber to use.

30. Portfolio and case study use

Lateral Cyber will not publish confidential client information without permission. Any use of client names, logos, testimonials, screenshots, case studies or portfolio examples should be agreed before publication.

31. Website availability and security

Reasonable effort is made to keep this website available and accurate, but Lateral Cyber does not guarantee that the website will be uninterrupted, error free, free from harmful components, compatible with every device or browser, or continuously available.

32. Third party links

This website may link to third party websites, platforms or resources. Lateral Cyber is not responsible for the content, privacy, security, availability, accuracy, pricing, terms or practices of third party websites or platforms.

33. Acceptable use of this website

Visitors must not misuse this website, attempt unauthorised access, interfere with website operation, submit harmful code, upload malicious files, scrape content, harvest information, impersonate another person, send spam, make false enquiries, or use the website for unlawful, misleading, abusive or harmful purposes.

34. Accuracy of information provided by visitors

Visitors and prospective clients must provide accurate and lawful information when contacting Lateral Cyber. Lateral Cyber may decline or stop responding to enquiries that appear false, misleading, abusive, unsafe, unlawful, outside capability, outside scope or inappropriate.

36. Australian Consumer Law

To the maximum extent permitted by law, Lateral Cyber is not liable for loss arising from reliance on general website information, unauthorised use of the website, visitor-submitted information, third party services, platform outages, delays, data supplied by a client, matters outside agreed scope, or business decisions made by a visitor or client.

38. No guarantee of commercial outcomes

Lateral Cyber does not guarantee that website work, cyber work, email setup, policies, Search Console setup, advertising tags, reports, recommendations or support services will result in a particular number of enquiries, sales, rankings, approvals, insurance outcomes, supplier outcomes, compliance outcomes or risk reduction level.

39. Indemnity

To the maximum extent permitted by law, visitors and clients agree to take responsibility for loss, claims, costs or damage caused by their misuse of the website, unlawful instructions, unauthorised access requests, inaccurate information, breach of these terms, or materials they provide without appropriate rights or authority.

40. Delays and matters outside control

Lateral Cyber is not responsible for delay or failure caused by events outside reasonable control, including third party platform issues, hosting outages, DNS propagation delays, client delays, supplier delays, internet outages, payment delays, access issues, illness, emergencies, security events or force majeure events.

41. Changes to website content and services

Website content, service descriptions, inclusions, exclusions, prices, availability and these terms may change from time to time. The latest version published on the website applies from the date shown above.

42. Disputes

If a concern arises, the person or business should contact Lateral Cyber first so the issue can be reviewed and addressed where possible. Client disputes may be handled under the applicable written agreement, proposal or service terms.

43. Governing law

These terms are governed by the laws of Queensland, Australia. Where permitted by law, the parties submit to the courts of Queensland, Australia.
